Frequently asked questions
The questions we hear most about U.S. immigration, visas, and study. Short, honest answers; your specific case always deserves a private conversation.
What is Americanite?
Americanite LLC is an immigration advisory service company registered in the U.S., with U.S. offices in Philadelphia, Pennsylvania and Berlin, New Jersey, plus four representative offices in Hanoi, Da Nang, and Ho Chi Minh City. We help with three areas: immigration, visas, and study in America.
Is Americanite a law firm?
We are a U.S.-registered immigration case-service company with over 15 years of experience and many successful cases — including complex ones that other offices had given up on. We have in-house attorneys and also work with a network of partner attorneys to support clients across all 50 U.S. states.
What does the free consultation include?
You describe your situation; we tell you the fitting category, the steps involved, realistic wait times, and estimated costs. No vague promises, no pressure to sign.
How are service fees calculated?
Quoted once, in full, per case type right after the first consultation, separate from U.S. government filing fees. No hidden fees and no surprises midway.
I live far from an office — how does that work?
Most of our clients handle their cases entirely remotely by phone, email, Zalo, or video call. Our U.S. team serves clients in all 50 states.
Is my information kept private?
Yes. Your immigration case is your family's private matter. We do not sell or share your information with third parties beyond what is needed to process your case. See our Privacy Policy for details.
Who can sponsor me to the U.S.?
U.S. citizens can sponsor a spouse, parents, children, and siblings. Permanent residents (green card holders) can sponsor a spouse and unmarried children. Each relationship falls under a category with a different wait time.
How long does spousal sponsorship take?
Usually around 1 to 2 years for the whole process, depending on timing and the processing center. The numbers change monthly; during your consultation we look up the latest figures for your case.
How long does sibling sponsorship (F4) take?
Currently around 13 years. No one can shorten this, and you should be wary of anyone who promises to. What you can control is filing early and correctly from the start.
Which categories have no waiting line?
Immediate relatives of U.S. citizens: spouse, unmarried children under 21, and parents. These have no annual visa cap, so you only wait for case processing.
What are the main paths to a green card?
Four groups: family, employment (including investment), refugee/asylum, and others such as the DV lottery or the K-1 fiancé visa. Choosing the right door up front saves years and money.
How much does EB-5 investment require?
From $800,000 when investing in a targeted employment area (TEA), plus proof of a lawful source of funds. Americanite handles this path with experienced U.S. EB-5 partner attorneys.
I'm in the U.S. past my visa — can I regularize my status?
It depends. Some people qualify to adjust status through a sponsoring relative without leaving the country. The sooner you act, the more options you have; we handle these cases with partner attorneys.
I have no relatives in the U.S. — is there any immigration path?
Yes: employment (job offer, extraordinary ability EB-1), EB-5 investment, or starting with study and building toward long-term employment. Each has different financial and documentary requirements.
Is a U.S. tourist visa hard to get?
The refusal rate is high, but most files fail because ties to Vietnam were not shown convincingly, not because the applicant is unqualified. Preparing the right focus makes a clear difference.
I was refused before — should I reapply?
Yes, if you can identify the reason and fix it. Reapplying with the same file almost always fails again. You can bring your old file in and we will review it for free.
How is a K-1 visa different from spousal sponsorship (CR-1)?
K-1 lets your fiancé(e) enter the U.S. and marry within 90 days, then adjust status for a green card. CR-1 means you marry first and arrive with a green card. Each suits a different situation; we compare them for your case.
How long does a K-1 case take?
The U.S. petition stage is usually around a year, plus consular processing. Timing varies case by case; we update the numbers during your consultation.
What do I need for the consular interview?
The original documents on your visa checklist, and answers consistent with the file you submitted. Americanite clients practice the interview beforehand with an experienced coach.
Does Americanite handle EB-3 work visas?
Not currently. We say so clearly so you don't waste time. We support family sponsorship, K-1, tourist, business, study, and EB-5 investment.
Once a U.S. visa is issued, how long is it valid?
B1/B2 visas for Vietnamese are usually valid 1 year, multiple entry. Each entry, the border officer grants a separate stay (often 6 months) on the electronic I-94 — that is your real permitted stay, not the date on the visa.
What budget do I need to send my child to study in the U.S.?
Our program advises within a $20,000–$60,000/year range, covering tuition and living costs, depending on school type and region. There are strong options at the lower end with smart school selection.
My child is a good but not outstanding student — can they go?
Yes, with a clear transcript and reasonable goals. The key is choosing a school that fits rather than chasing prestige; the mentor helps with this.
What is an I-20?
The I-20 is the certificate of enrollment a U.S. school issues after admission. It is required to pay the SEVIS fee and apply for the F-1 student visa.
How far in advance should we start?
Ideally 9–12 months before the intake, so school selection, English testing, and the visa are not rushed. It can be done faster, with fewer options.
My child is under 18 — who cares for them in the U.S.?
High school students stay in a dorm or with a host family arranged by the school. Americanite's U.S. team stays in touch and helps when the family needs it.
Can they reapply after failing the F-1 interview?
Yes. Before booking again, adjust how the study plan and financial proof are presented — the two most common reasons for refusal. The mentor practices again with the student.
Can F-1 students work after graduation?
F-1 graduates can apply for OPT (12 months of formal training), with a 24-month extension for STEM fields. Staying long-term requires switching to a work visa (H-1B) or another immigration path, and nothing is guaranteed up front.
How many steps are there when working with Americanite?
Four: you get in touch and describe your situation; we review your case for free; both sides prepare and file; we stay with you through the result and support you even after you arrive in the U.S.
What documents do I need to get started?
It depends on the case type. After the first consultation, you receive a checklist tailored to your situation, with guidance on where to obtain each document.
Which channels do you use for remote work?
Phone, email, Zalo, and video call. Our offices in Hanoi, Da Nang, HCMC, and New Jersey see clients by appointment.
How am I kept updated while waiting?
We report progress regularly and notify you as soon as your case hits a new milestone. You always know where your case stands.
Why are the timelines on the website only estimates?
U.S. government processing times change monthly with case volume and the visa bulletin. During your consultation we look up the latest numbers for your exact category rather than using a generic figure.
